Terms and Conditions

These Terms and Conditions govern your access to and use of https://dmishopfitting.com (“the Website”) and any services provided by DMI Shopfitting Limited (“we”, “us” or “our”). By using the Website or placing an order, you agree to be bound by these terms.

     

    1. Definitions
    • “Client” means any person or entity ordering products or services.
    • “Contract” means the agreement between DMI Shopfitting Limited and the Client.
    • “Services” means design, manufacture, supply and installation of shopfitting fixtures.
    • “Goods” means any products supplied by DMI Shopfitting Limited under the Contract.

       

      1. Website Use
      • You must be at least 18 years old to place an order.
      • You agree not to misuse the Website or upload harmful content.
      • We may suspend or terminate access at our discretion.

         

        1. Quotation and Acceptance
        • All quotations are valid for 30 days unless stated otherwise.
        • A Contract is formed when we issue a written acceptance of your order or deposit payment.
        • Changes to scope must be agreed in writing and may incur additional charges.

           

          1. Prices and Payment
          • Prices are exclusive of VAT and delivery charges unless stated.
          • Payment terms are 30 days from invoice date unless otherwise agreed.
          • Late payments incur interest at 2% above the European Central Bank base rate.

             

            1. Delivery and Installation
            • Delivery dates are estimates and subject to confirmation.
            • Risk passes to you upon delivery to the agreed location.
            • Installation dates must be agreed in advance; additional fees apply for re-scheduling.

               

              1. Returns and Cancellations
              • Goods may only be returned with prior written consent.
              • Custom-made items are non-returnable unless defective.
              • Cancellation by the Client after order acceptance incurs a 25% cancellation fee.

                 

                1. Warranties and Liability
                • We warrant that Goods will conform to specifications for 12 months from installation.
                • Our total liability for direct loss is capped at the Contract price.
                • We are not liable for indirect, consequential or punitive damages.

                   

                  1. Intellectual Property
                  • All design drawings, plans and specifications remain our intellectual property.
                  • You may not reproduce, modify or distribute our materials without our consent.

                     

                    1. Confidentiality
                    • Both parties must keep confidential information secure and not disclose it to third parties.
                    • This obligation continues for five years after termination of the Contract.

                       

                      1. Data Protection
                      • We process personal data as set out in our Privacy Policy.
                      • By entering into a Contract, you consent to our processing of your data.

                         

                        1. Force Majeure
                        • Neither party is liable for delays caused by events beyond reasonable control (e.g., strikes, natural disasters).
                        • Affected obligations are suspended for the duration of the event.

                           

                          1. Termination
                          • We may terminate for material breach if non-compliance is not remedied within 30 days of notice.
                          • On termination, all sums outstanding become immediately due.

                             

                            1. Governing Law and Jurisdiction
                            • These Terms are governed by Irish law.
                            • Disputes fall under the exclusive jurisdiction of the Irish courts.

                               

                              1. Amendments

                              We reserve the right to amend these Terms. Updated versions will be posted on the Website with a revised “Last updated” date.
